I recently received an email from a couple hoping to elope at the Wee Wedding Cottage this coming weekend. At the end of his message, the groom-to-be added, “I just heard that if she’s been divorced in the U.S., there might be an issue. Is that true?”
Unfortunately… yes, it’s a big issue.
I had to let him know that a legal wedding this weekend wouldn’t be possible—but I could offer a beautiful non-legal celebration of their love in the meantime. They were so disappointed.
The problem? Since the tightening of international document requirements after 9/11, anyone divorced outside of Canada must have their divorce papers verified by a Canadian lawyer. It’s a safeguard to prevent fraud and ensure proper documentation. But it also adds time and expense to the process. Without that verification, the province simply won’t issue a marriage licence.
And most people have no idea.
So, what should you do if you’re divorced outside of Canada?
If either of you was previously married outside of Canada, here’s what you’ll need before you can legally tie the knot here in Ontario:
1. Get Your Divorce Documents Reviewed
You must submit a completed Marriage Licence Application along with the following to ServiceOntario:
- An original or court-certified copy of your divorce decree (not a photocopy),
- A legal opinion letter from a Canadian lawyer stating that the divorce is valid and recognizable under Ontario law.
2. Work With a Canadian Lawyer
The legal opinion letter is essential and must be written by a lawyer qualified to practice in Canada. It’s called a “verification” and is offered by many lawyers across Ontario.
3. Build in Extra Time
This process can take several weeks. It’s not something that can be rushed for a last-minute wedding weekend, no matter how ready you are to say “I do.”
